§ Rule 72 Guardians and conservators

Rule 72. Guardians and conservators

    (a) Uniform Probate Code--Guardians and Conservators. A guardian appointed previous to the effective date of the Uniform Probate Code on July 1, 1972, shall have the following powers and duties:

        (1) Guardians of the person, only, of a minor or incompetent shall have all the powers and duties of guardians under chapters 2 and 3, article V of the Uniform Probate Code.

        (2) Guardians of the estate, only, of a minor or incompetent shall have all of the powers and duties of a conservator under chapter 4, article V of the Uniform Probate Code.

        (3) Guardians of the person and estate of a minor or incompetent shall have all of the powers and duties of a guardian under chapters 2 and 3, article V and of a conservator under chapter 4, article V of the Uniform Probate Code.

        (4) No order of a magistrate or judge shall be necessary to grant these powers and duties to the existing guardians upon the effective date of the Uniform Probate Code.
