§ 24-10-3. Fees where cause continued for witnesses' absence

(a) A witness shall not receive any fees whatever for attendance on a subpoena if he is absent from the trial, or if the trial is continued at any time for his absence, where his absence did not arise from providential cause.

(b) No witness shall receive fees from both parties in the same case; the fees of a witness for both parties shall be apportioned equally between the parties unless the costs are all taxed against one party.
